Noise Variance

Permission to vary from the Bellevue City Code (BCC) 9.18 pertaining to requests to generate noise outside of code-specific permitting hours and for more than 30 days. 

Apply for this permit online at MyBuildingPermit. When entering your Application Information, choose the following:

1. Application type: Land Use
2. Project type: Nonresidential
3. Activity type: Deviations, Modifications, Variances, or Waivers
4. Scope of work: Noise Variance

Required Documents

The documents listed below are the minimum necessary to proceed with the application process.

1. Bill To Form
2. Site Narrative
3. Project Narrative

The Site Narrative should include:

• Plans showing location(s) of where noise variance is requested
• 500' mailing radius map with addresses to assist with public notification

The Project Narrative should include: 

• The overall timeframe requested and identify the day and/or nights of the week that the work would occur and any instances where noise is anticipated for multiple consecutive days
• Is the work exempt from SEPA under WAC 197-11-800(26)?
• Written Responses to Noise Variance Criteria (WAC 173-60-080):
  • An implementation schedule that includes the overall timeframe of the request and days/times of when noise will be generated outside of normal construction hours shall be documented. Requests for an extended timeframe will not be accepted without some amount of predictability to issue a noise variance approval. 
  • Provide an explanation of the exceptional circumstances for why the work needs to be approved outside of normal construction hours. Work outside of normal construction hours cannot be approved, except in extraordinary circumstances where overriding considerations of public interest dictate the issuance of a variance.
